Abstract

The articles concerns legal character of relative invalidity of a civil law act transferring ownership, adjudicated on ground of insolvency and restructuring law. Author tries to find out whether relative invalidity is only an enforcement measure or does it actually results in transfer of ownership of assets back to debtor.

Abstract in Polish (Streszczenie)

Przedmiotem rozważań autora pozostaje problem charakteru bezskuteczności wynikającej z przepisów prawa upadłościowego i restrukturyzacyjnego w odniesieniu do czynności przenoszących własność. W tekście stara się on rozstrzygnąć czy bezskuteczność wobec masy należy traktować jako środek egzekucyjny czy też prowadzi ona do trwałego przeniesienia własności składników majątku objętego bezskutecznością na dłużnika.
