Umowa dowodowa a zasada prawdy materialnej

Abstract

The author discusses the changes that have been made in the Code of Civil Procedure in 2019. In the author's opinion, there is a contradiction between the principle of substantive truth in force in the Code of Civil Procedure and the possibility of concluding an evidence agreement that restricts the admissibility of certain evidence.

Abstract in Polish (Streszczenie)

Autor omawia zmiany jakie zostały dokonane w Kodeksie postępowania cywilnego w 2019 roku. W ocenie autora istnieje sprzeczność pomiędzy zasadą prawdy materialnej obowiązującą w Kodeksie postępowania cywilnego a możliwością zawierania umowy dowodowej, która ogranicza dopuszczalność przeprowadzania niektórych dowodów.
